If you are in need of a Michigan personal injury attorney, consider the experienced attorneys at Gold Star Law. We are aggressive advocates for victims’ rights.
We are not afraid of the big insurance companies such as State Farm or Allstate. We know what works and we know how to succeed.
Don’t call the insurance company first. They will fool you into believing that you will be well compensated for your accident. Ironically, it is their goal to give you as little as possible in order for you to sign away your rights. Let Gold Star Law help you understand your rights and get you the compensation you deserve. TRUCK OR AUTO ACCIDENT –
PERSONAL INJURY PROTECTION
If you have been injured in an automobile or truck accident in Michigan, you are entitled to recover Personal Injury Protection Benefits (PIP), also known as No-fault Benefits. PIP Benefits are paid by the automobile insurance company covering the vehicle you were occupying when injured (generally your own automobile insurance carrier if injured while driving / riding in your own vehicle). If you were driving / riding in a company vehicle, your employer’s automobile insurance carrier is responsible for payment of PIP benefits.
Under Michigan law, in the case of a truck or auto accident, the PIP carrier is responsible for payment of medical expenses, household replacement services, attendant care and lost wages.
CLAIMS AGAINST THE OTHER DRIVER WHO CAUSED THE ACCIDENT
If the accident was the fault of another person who was driving, whether you were in that driver’s car or another car involved, you have a right to make a claim against the driver who caused the accident. This claim is about your level of pain and suffering and your future lost wages beyond a three year period, and the Court will consider whether you’ve suffered an actual injury because of the crash that has affected your lifestyle in some way.
If you are injured in an automobile or truck accident, it is important that you notify the police and make sure a police report is completed, seek medical treatment and report all of your symptoms and injuries, and take plenty of pictures of your injuries and your damaged vehicle. Most importantly, do not give a statement to the insurance company until you have consulted with an attorney. Contact us today to find out more about what you should do if you’ve been in an accident.
UNINSURED AND UNDERINSURED COVERAGE
If your injury was caused by an uninsured driver, you may recover Uninsured Motorist Benefits (UM) from your own automobile insurance company. UM coverage is mandatory for all automobile policies.
If your injury was caused by a driver who had coverage, but not nearly enough coverage to cover your total damages, you may recover Underinsured Motorist Benefits (UIM) from your own automobile insurance company if you have elected to purchase UIM coverage as part of your insurance policy. Unlike Uninsured coverage, Underinsured Coverage is optional.
We highly recommend all Michigan drivers obtain Underinsured Motorist coverage, as drivers who cause accidents often only have insurance for the minimum liability amount.
